Terms and Conditions of Use Agreement for All Users

 

This website is provided by the Saskatchewan Geomatics Data Cooperative which includes certain executive government departments, Information Services Corporation of Saskatchewan (“ISC”) and other organizations (collectively, the “Cooperative”) to offer public access to geomatics data, including maps, metadata and other spatial data. This website is owned and operated by ISC. Members of the Cooperative and registered publishers may contribute geomatics data to this website for access and distribution.

 

The parties to this Agreement are ISC, the Cooperative and the person, individual or entity (“you”) that accesses this website and/or any of the geomatics data, including maps, metadata or other spatial data or other output produced by or from this website (the “Data”) by either viewing, downloading, copying, printing or otherwise using all or any portion of the Data.

 

By accessing this website and/or the Data, you are deemed to have accepted and agree to be bound by this Agreement and all codes of conduct established by ISC and/or the Cooperative from time to time. You agree these terms and conditions constitute a binding contract between you, ISC and the Cooperative.

 

These terms and conditions are subject to change, without prior notice to you, at ISC’s discretion, and you agree that you shall be bound by such changes. You agree to observe the terms and conditions of this Agreement when accessing this website and/or the Data and to maintain your awareness of these terms and conditions at all times.

 

 

Intellectual Property

 

The contents of this website, including without limitation, website design, text, graphics and the selection and arrangement thereof and all software are protected by copyright laws and are owned by ISC and its Licensees. The Data shall at all times remain the property of ISC or the relevant registered publisher and may be protected by copyright laws, other intellectual property laws, common law or international treaties.

 

 

Use of Data

 

The Data on this website is made available for public access, however, there are restrictions on the use of the Data listed in Schedule A attached to these terms and conditions (the “Restricted Data”).  Any Data displayed on this website that is not listed as Restricted Data in Schedule A is to be considered “Unrestricted Data”.

 

You may reproduce any Data, in whole or in part, and/or use the Data for public policy research or educational purposes provided the source of the Data is acknowledged in all documents or communications in the following manner:

ISC may establish limits on the use of the Website from time to time. For example, ISC may limit the number of days the website will retain your saved searches, the number of downloads you attempt to access, and/or the type of Data you attempt to access or download. If you exceed these limits, ISC reserves the right to cancel your registered user account and/or otherwise deny you access to this website.

 

This website is monitored. If monitoring reveals evidence that you have misused the Data or this website or that your use has breached any of these terms and conditions, ISC reserves the right to enforce its rights under this Agreement against you, either on its own behalf or on behalf of the Cooperative or the relevant registered publisher of the Data. If ISC or the Cooperative fail to exercise or delay in exercising any right or remedy under this Agreement, such failure or delay will not be deemed to be a waiver of that right or remedy. If ISC or the Cooperative waives any breach of any provision of this Agreement, such waiver will not be deemed to be a waiver of any subsequent breach of that or any other provision.

 

Use of Unrestricted Data

 

Subject to these terms and conditions, ISC, on its own behalf or on behalf of the registered publisher of the Unrestricted Data, grants to you a non-exclusive, world-wide, non-transferable, non-assignable, royalty-free licence to use, reproduce, extract, modify, improve, translate, further develop, distribute the Unrestricted Data, manufacture or cause to be manufactured any product, system, sub-system, device, component, material or software that incorporates or uses any part of the Unrestricted Data.

 

Use of Restricted Data

 

Any commercial use of the Restricted Data, in whole or in part, is prohibited except with ISC’s prior written permission. For instance, you may not, without ISC’s prior written permission:

 

a.       embed or merge the Restricted Data with any software applications, or other data or information in any form;

b.       publish the Restricted Data in any form, in whole or in part; or

c.        engage in “screen scraping” or any other activity intended to collect, store, reorganize or manipulate the Restricted Data.

 

For more information or to obtain a licence to use any of the Restricted Data beyond the scope permitted by this Agreement, please contact ISC’s Portal Administrator Portal.Admin@isc.ca. A licence fee may be applicable.

 

 

Security

 

Any action that might reasonably be construed as compromising, altering or rendering ineffective this website is strictly forbidden. You may not decompile, disassemble or reverse engineer this website.

 

This website is monitored. If monitoring reveals evidence of misuse, criminal activity or any use that breaches these terms and conditions, ISC reserves the right to use any and all information collected as part of an internal investigation or other enforcement proceeding.

Additional Terms and Conditions of Use for Registered Users

 

These additional terms and conditions apply to you if you have requested or have been issued an account to access various services offered by this website as a registered user.

 

You are deemed to have accepted these additional terms and conditions by selecting the “I AGREE” button at the end of this Agreement. You must then provide certain information following this Agreement. ISC, upon receipt of your completed registration, may, at its sole discretion, issue you a registered user account. If ISC does not issue you a registered user account, this Agreement will be rescinded.

 

In consideration of ISC issuing you a registered user account, you:

 

1.       agree to be bound by these additional terms and conditions;

2.       agree this Agreement, including these additional terms and conditions, constitutes a binding contract between you, ISC and the Cooperative;

3.       consent to the collection of your registration information;

4.       consent to the disclosure of your registration information to the members of the Cooperative;

5.       will not permit any third party to use your registered user account;

6.       will not divulge, share or compromise your registered user account password;

7.       will not use or attempt to use the registered user account of any other person;

8.       will not test or examine the security related to your registered user account;

9.       acknowledge that these additional terms and conditions are subject to change, without prior notice to you, at ISC’s discretion, and you agree that you shall be bound by such changes; and

10.    agree to observe the terms and conditions of this Agreement, including these additional terms and conditions, when accessing this website and/or the Data and to maintain your awareness of these terms and conditions at all times.


ISC may, in its sole discretion, cancel your registered user account at anytime:

 

1.       if you fail to abide by any of the terms and conditions of this Agreement, including without limitation, these additional terms and conditions;

2.       as a security measure; or

3.       for administrative purposes.

 

If you do not use your registered user account for a period of six consecutive months, it may be classified as inactive and may be cancelled.

 

Upon termination or cancellation of your registered user account, ISC may delete your information permanently. You are responsible for taking the necessary steps to back up your information.

 

Additional Terms and Conditions of Use for Publishers

 

These additional terms and conditions apply to you if you have requested or have been issued an account that permits you to register, upload, create and manage Data on this website as a registered publisher.

 

To become a registered publisher on this website, please contact ISC’s Portal Administrator Portal.Admin@isc.ca ISC, upon receipt of your completed registration, may, at its sole discretion, issue you a registered publisher account. If ISC does not issue you a registered publisher account, this Agreement will be rescinded.

 

In consideration of ISC issuing you a registered publisher account, you:

Any personal information you provide to ISC through this website will be handled in accordance with the principles outlined in the Privacy Statement for All Users set out below, with the exception of any personal information you choose to disclose in metadata that you publish on this website. You consent to the voluntary disclosure of such personal information in metadata published by you on this website.
